South West Megagames: Terms and Conditions (PDF Game Packs)

1. About us

These terms apply when you ("the buyer") purchase a PDF game pack from South West Megagames, run by John Mizon as a sole trader ("we" or "us").

By confirming your order, you agree to these terms. Nothing in these terms affects your statutory rights as a consumer.

2. Placing an order

1. Products shown on our website are not an offer to sell. We may decline any order for any reason.

2. To order, email us at contact@swmegagames.co.uk. Before we accept your order, we will ask you to confirm by email that you have read and agree to these terms, including the statement in section 4.

3. Prices are as shown on our website at the time you order. We are not VAT registered, so no VAT is charged.

4. Your order is accepted, and the contract between us is formed, when we receive your payment or, for a £0 order, when we confirm by email that we will send your pack.

5. If you are under 18, please make sure you have a parent's or guardian's permission before buying.

3. Delivery

We will email the game pack to the address you ordered from, usually within 1 to 3 working days of receiving your payment and no later than 30 days. If there is a delay to the usual delivery time, we will do our best to let you know. If we cannot deliver within 30 days, you may cancel your order and we will refund you in full.

4. Your right to cancel

Consumers normally have 14 days to cancel an online purchase. For digital content such as our PDF packs, this right ends once we send you the pack, provided you have agreed to this beforehand.

By confirming that you have read and agree to these terms, you expressly agree to receive your pack immediately and acknowledge that you lose your 14-day right to cancel once it has been sent.

You may cancel at any time before we send the pack, and we will refund you in full.

5. If something is wrong with your files

Your game pack should match its description and the files should open and work properly. If a file is faulty, missing or not as described, please email us and we will replace or correct it. If we cannot fix the problem, we will give you a full or partial refund, as appropriate.

We are also happy to help with questions about running the game, and to resend files if you lose your copy.

6. Licence and terms of use

The game designs and materials remain the copyright of South West Megagames. When you pay, you receive a licence for you personally to use them as set out below. At our discretion, we may agree in writing to extend the licence to your group or organisation.

• Running the game: you may use and print the materials to run the game as many times as you like.

• Adapting the game: you may make your own changes and additions. If you make significant changes (for example, to the rules, setting or structure), you must change the game's title or add a subtitle making clear it is a modified version.

• Credit: you must credit the original designer and South West Megagames, and make clear what you have changed. Materials you have not changed remain our copyright.

• Non-commercial use: you may run the game on a non-commercial basis, and may charge players enough to cover your reasonable costs (such as venue hire and printing). Charging more than this, or any other commercial use, requires our written permission.

• Sharing: you may not pass on the game pack, or substantial parts of it, to anyone else without our written permission. You may share selected materials with players, controllers and helpers where needed to run the game.

7. Your personal information

We handle your personal information in line with the UK GDPR and the Data Protection Act 2018. We use your details only to process your order and to contact you about it, and we keep them only as long as needed for those purposes and to meet our legal and tax obligations. Full details are in our Privacy Policy.

We need to contact you by email to process and deliver your order, so we cannot complete an order without an email address.

8. Our liability

If we fail to meet these terms, we are responsible for loss you suffer that was a foreseeable result of that failure. Our total liability to you is limited to the price you paid for the game pack. This does not limit any liability that cannot legally be limited.

9. Law and disputes

These terms are governed by English law. If you have a problem, please contact us first and we will do our best to resolve it.

Any dispute may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings there. If you live outside the UK, you keep any consumer protections that the law of your own country gives you.

10. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the one you agreed to when you ordered.
